Petition filed against state pharmacy council election in Delhi

A petition against Delhi state pharmacy council election in Delhi by Delhi Pharmacops association. The association is demanding to hold fresh elections of Delhi Pharmacy Council and most preferably under direct supervision of Election Commissioner by mode of physical voting for a fair & transparent election.

 Delhi Pharmacops Association said, the election process of Delhi Pharmacy Council Election 2021 has been very suspicious and got caught into an outrageous wrongdoing. This process challenges the validity of the election process to be conducted under Rule 24 of the Pharmacy Act 1948 constituted with Rule 6(20, 21) of Rules 1964 as amended by the Delhi Pharmacy Council as reported by Delhi Pharmacops Association. And they filed a petition against election.

Delhi pharmacops association said, "First of all 1500-2000 valid names were disappeared from the voter list by Delhi Pharmacy Council Registrar, then ballot papers were not sent to hundreds of the remaining voters. Counting was started by them on 30 tables on the day of counting, in which the counting officers were not correct according to the rules of the government. More than half of the employees were from class IV who had no idea about the sensitivity of the election and they made 3 officers sit at a table, but the candidates were made to sit at such a distance that they could neither know which ballot paper belongs to which candidate nor allowed to appoint a counting agent."

Petition said, "An elector who has not received his voting paper and other connected papers sent by post or whose paper, before they have are dispatched back to the Returning Officer have been inadvertently spoiled in such manner that they cannot be conveniently used or who has lost his papers, may, on his transmitting to the Returning Officer a declaration to that effect signed by himself require the Returning Officer to send him duplicate papers in place of those not received, spoilt papers shall be returned to the Returning Officer who shall cancel them on receipt. In every case when duplicate papers are issued, a record thereof shall be kept by the Returning Officer and mark Duplicate shall be placed on the bigger cover, which will bear the same serial alphabetical number as was originally given to the said elector, The voting papers issued in such cases shall also be marked DUPLICATE.
However, till date it has not been disclosed as to the number of ballot papers received back, how many were undelivered, how many rejected during counting, how many duplicate were issued, etc."


In this context, a petition has also been given by Shri Vikas Tusir to Hon'ble L.G. Delhi, Chief Secretary, Principal Secretary along with an affidavit. Apart from this, complaint filed for non-compliance of D.O.P.T. Rule to Honorable Prime Minister, Honorable L.G. Delhi, Central Vigilance Commission, Chief Secretary Delhi Government, Principal Secretary also has been done.

In a petition Delhi Pharmacops association asked to hold fresh elections of Delhi Pharmacy Council of NCT of Delhi, most preferably under direct supervision of Election Commissioner by mode of physical voting for a fair & transparent election.
